A Remarkable Week in Court for LEX Law Offices
28. November, 2024At LEX law offices, we pride ourselves of our strong team of litigators. While we are no strangers to landmark victories in Icelandic courts, the past week has been exceptionally fruitful for our clients.
On Friday, November 22nd, the Reykjavík District Court ruled in favour of the Torg Bankruptcy Estate against the Icelandic Government. Represented by our own Þórhallur Bergmann, the court rescinded VAT payments made by the estate. This ruling reaffirms Þórhallur’s standing as a leading lawyer in insolvency, bankruptcy, and financial restructuring in Iceland. In recent years, he has been retained by creditors of numerous bankruptcy estates to review actions taken during the periods leading up to bankruptcy, achieving significant success.
On Tuesday, November 26th, junior litigator Guðrún Sólveig Sigríðardóttir, under the supervision of seasoned partner Óskar Sigurðsson, secured a favourable ruling in the Reykjavík District Court. She successfully represented plaintiffs in a claim regarding ownership of land and fishing rights. For decades, LEX Law Offices has been at the forefront of property law in Iceland, and it is pleasant to see a member of the younger generation like Guðrún Sólveig carry on our strong tradition in this field.
On Wednesday, November 27th, the Supreme Court of Iceland published its ruling in the case of the Merchant Pension Fund against an individual. Our partner, Kristín Edwald, represented the pension fund, strongly supported by Stefán Orri Ólafsson and Hjalti Geir Erlendsson. The Supreme Court ruled fully in favour of the pension fund. This victory showcased LEX’s depth and ability to combine knowledge and experience from different practice areas to form a successful team. The case involved the re-evaluation of pension rights based on changes in life expectancy; a ruling against our client could have had a devastating effect on the Icelandic pension system.
That same day, the Supreme Court declined to grant permission to appeal a ruling issued by the Appeal Court in a case where our attorney, Guðjón Ármannsson, supported by Fjölnir Ólafsson, successfully argued for the invalidation of a will involving valuable real estate in the capital area, worth billions of ISK. This outcome brought a favourable resolution to a high-stakes dispute, exemplifying our attorneys’ precision and strategic advocacy in complex cases.
Finally, on November 28th, the Appeals Court issued its ruling in the matter of Lyfjablóm against a client of LEX. Our attorney, Arnar Þór Stefánsson, successfully defended his client in this longstanding dispute involving corporate governance that traces its roots back to the financial crisis.
